Board Policy BP 4313.1 Management, Supervisory and Confidential Personnel
Load/Scheduling/Hours Of Employment The Board of Education may specify certain positions or classes of positions as supervisory, administrative, or executive and exclude the employees serving in such positions and the positions from the overtime provisions. (Education Code 45130)
The Board designates in accordance with law salaried positions which are exempt from overtime. Persons holding these positions work whatever hours are necessary in order to fulfill their assignments. Their positions are set apart from other positions by virtue of the duties, confidential notice of the position, flexibility of hours, salary, benefit structure and authority which they entail.
Employees serving in positions excluded from overtime shall not be unreasonably discriminated against as a result of the exclusion. (Education Code 45130)
The Board specifies these Personnel positions exempt from the overtime provisions:
Certificated Management Personnel - Less than 12-Month Personnel
Elementary Principal Assistant Principal (Intermediate School) Associate Principal (High School)
Classified and Certificated Management - 12-Month Personnel
Intermediate Principal High School Principal Continuation School Principal Coordinator, Curriculum & Instruction Director, Recreation/Community Programs Plant Manager Director, Food Services Director, Purchasing Director, Technology Director, Fiscal Services Administrator, Pupil Services Assistant Superintendent/Human Resources Assistant Superintendent/Educational Services Deputy Superintendent/Business Services Superintendent of Schools
Management Supervisory Personnel
Accountant Child Care Site Supervisor Enrichment Coordinator Assistant Director, Adult Education Assistant Director, Child Care
Exempt employees' pay shall not be subject to salary deductions for absences of less than a day.
